TERMS OF USE AGREEMENT
Acceptance of Terms & Conditions
You agree that by clicking “I agree with itworks.asia’s Terms & Privacy” or taking similar actions, applying for jobs, accessing, or using our services, you enter into a legally binding agreement governed by the service usage regulations of AnyWork Co., Ltd. (the operating entity of itworks.asia). If you wish to terminate this agreement, you may do so at any time by closing your account and ceasing all access to or use of our Services. - Members and Visitors: When you register an account on itworks.asia, you become a Member of the Website. If you do not register an account, you may only access certain features as a “Visitor” with certain limitations.
- Changes: During operation, in order to comply with legal regulations and ensure personal data security, itworks.asia may amend this Agreement and the Privacy Policy. If significant changes are made, itworks.asia will notify you through various methods to ensure that you have the opportunity to review the changes before they take effect. Your continued use of the Services after the changes become effective constitutes your acceptance of the revised terms.
Services of itworks.asia
itworks.asia is a website on the Internet designed to allow users to post recruitment advertisements and/or view jobs posted by other users, as well as interact with other users. itworks.asia is owned and operated by AnyWork Co., Ltd.. The Website contains and may contain information, news, opinions, text, graphics, links, electronic artwork, animations, audio, video, software, images, music, sounds, and other content or data (collectively referred to as “Content”) organized and formatted in various forms accessible by users, including directories, databases, and areas of the Website that users may modify, such as recruitment advertisements, multimedia uploads, user registrations, and profile creation (“Interactive Areas”). To fully use the services and utilities available on itworks.asia, you are required to create an account and provide certain personal information, including but not limited to your email address, for communication purposes between you, itworks.asia, and other users. By registering, you agree to receive notifications, emails, and other communications regarding products and services of itworks.asia. If you no longer wish to receive such communications, you may unsubscribe using the available unsubscribe function on the Website or at the bottom of emails sent by itworks.asia. Your personal information will be stored and processed securely in accordance with the Privacy Policy of itworks.asia. You may purchase and use services or products at the listed prices available on the Website, subject to partial or full acceptance of the ordering conditions by itworks.asia. Such acceptance only becomes binding after payment has been completed or your payment information has been verified. itworks.asia reserves the right to modify services, products, pricing structures, pricing methods, and other operational matters from time to time without prior notice to users where deemed appropriate.
Ordering and Payment Services
- You may purchase one or more services listed in the Service List of itworks.asia through an Order Form and/or Service Agreement.
- If the purchased service is a Recruitment Posting Service:
- The recruitment position will be displayed on itworks.asia for thirty (30) days from the activation date. The job title may not be changed after the recruitment post has been activated on the Website.
- Each recruitment post may include only: one (01) job title, one (01) job description, and one (01) set of job requirements.
- Services of itworks.asia may be paid in advance or after use via cash, bank transfer, or credit card. The list of accepted credit cards will be published on the Website. Service Fees must be paid no later than the Payment Date specified in the Order Form. Purchased Services will be activated within three (3) working days from the date the Customer completes payment of the Service Fees. If the Customer fails to make payment by the Payment Date, the Company reserves the right to temporarily suspend service provision until full payment has been completed.
- The Company shall issue VAT invoices in accordance with Vietnamese law upon Customer request. Customers are responsible for the accuracy of invoice information provided.
Terms of Service Usage
- After you have paid the Service Fees and/or activated purchased Services, we will not accept any requests for temporary suspension, cancellation, refund of Service Fees, or service changes.
- You are responsible for creating and maintaining your own account and password to use services on itworks.asia.
- You are permitted to post your recruitment information and/or links directing users to recruitment content on your own website, and you are fully responsible for the accuracy and legality of such content.
- You must activate purchased Services within their validity period. Any purchased Services that are not activated before expiration shall become invalid.
- In the event of intentional fault on our part, if after seven (7) working days from the date we receive your written reminder regarding such violation we still fail to remedy the issue, we shall refund the Service Fees corresponding to the unused portion of the Services under the applicable Order Form/Service Agreement that we failed to provide in accordance with the agreement between both parties.
Rights and Responsibilities of Users
Access to the Website itworks.asia: You are responsible for providing all hardware, software, telephone lines, communication devices, and/or Internet connection services necessary to access and use itworks.asia. You are also responsible for paying all Internet access fees, telephone charges, and other costs incurred during your connection to and use of the Website.
User Conduct: When using the services of itworks.asia and accessing the Website, you fully acknowledge and agree not to engage in the following prohibited activities:
- Opposing the Socialist Republic of Vietnam, undermining national unity, propagandizing, distorting, inciting, or distributing information against the State of Vietnam;
- Inciting violence, promoting aggressive wars, creating hatred among ethnic groups or nations, promoting obscenity, depravity, crime, social evils, superstition, or damaging Vietnamese cultural traditions and customs;
- Disclosing state secrets, military secrets, security, economic, foreign affairs information, or other confidential information protected by law;
- Defaming, slandering, or infringing upon the reputation, dignity, or honor of organizations or individuals;
- Advertising or promoting goods and services prohibited by law;
- Discussing political or religious issues;
- Using offensive or uncivilized language contrary to Vietnamese ethics and traditions;
- Restricting or preventing other users from accessing or enjoying interactive features;
- Sending or transmitting unlawful, threatening, abusive, defamatory, obscene, offensive, or otherwise inappropriate information, including but not limited to content encouraging criminal conduct, giving rise to civil liability, or violating local, national, or international laws;
- Sending or transmitting information, software, or materials that infringe upon the rights of others, including privacy rights, copyrights, trademarks, trade names, or other proprietary rights without authorization from the lawful owner;
- Sending or transmitting information, software, or materials containing viruses or harmful components;
- Modifying, damaging, deleting, or interfering with any content or features not owned by you, or obstructing others from accessing the Website;
- Disrupting the normal flow of communication within interactive areas;
- Falsely claiming association with or speaking on behalf of any business, association, institution, or organization without authorization;
- Using the Website for unlawful purposes, including but not limited to violations of any policies, rules, or usage guidelines of your Internet service provider or online services.
Interactive Areas
You acknowledge that itworks.asia may contain various interactive areas, including but not limited to job posting sections. These interactive areas allow communication with itworks.asia and real-time interaction among users. You further understand that itworks.asia does not control messages, information, or files distributed through such interactive areas and that itworks.asia may allow you and other users to create and manage interactive areas. However, AnyWork Co., Ltd., its parent company, affiliates, directors, employees, contractors, and agents shall not be responsible for any content within interactive areas. Your use and/or management of any interactive area shall be governed by this Agreement and any additional rules or operating procedures established by you or other users. You acknowledge that itworks.asia cannot and does not intend to pre-screen information posted in interactive areas. Furthermore, because itworks.asia encourages open and unbiased communication, it cannot determine in advance the accuracy or compliance of any content transmitted through interactive areas with this Agreement. itworks.asia is not responsible for screening, monitoring, editing, approving, or supervising content within interactive areas. Nevertheless, you agree that itworks.asia reserves the right to monitor interactive areas and disclose information where required by law, government request, operational necessity, or to protect itself and other users. If notified of content that may violate this Agreement, itworks.asia may investigate and determine, at its discretion, whether to remove such content or require users to remove it. itworks.asia reserves the right to prohibit activities, communications, or content within interactive areas and to edit, refuse publication of, or remove any content, in whole or in part, which, at its sole discretion, it considers:
- In violation of this Agreement or any other applicable policies of itworks.asia;
- Harmful to the rights of users, itworks.asia, or third parties;
- In violation of applicable laws; or
- Otherwise inappropriate or objectionable.
Intellectual Property Rights
Content of the itworks.asia Career Website
You acknowledge that the itworks.asia Website allows access to Content protected by copyrights, trade names, and other proprietary rights (including intellectual property rights) (“Intellectual Property Rights”), and you acknowledge that such Intellectual Property Rights are valid and protected in all current and future media. Except as expressly stated herein, your use of the Content shall be governed by applicable copyright laws and other intellectual property laws. You agree and acknowledge that all content on itworks.asia including but not limited to resumes/CVs, shall remain the sole intellectual property of AnyWork Co., Ltd. and itworks.asia. You are not permitted to modify, copy, reproduce, transmit, distribute, publish, create derivative works from, display, transfer, or commercially exploit any part of the Content, whether in whole or in part. However, you may: Create a digital or other copy necessary for your computer hardware and software to access and display the Content; Print one copy of each piece of Content; Create and distribute a reasonable number of copies of the Content, in whole or in part, in printed or electronic form for internal use only. Any permitted copy of the Content must reproduce all notices contained in the original Content in an unaltered form, including all notices relating to Intellectual Property Rights, the source reference to “itworks.asia Career Website,” and its network address (URL). You shall not obtain any Intellectual Property Rights merely by downloading or printing the Content. Any unauthorized copying or commercial use of the Content shall constitute infringement and may be handled in accordance with applicable laws and the provisions of this Agreement. Content Provided by Users: You may only upload, transmit, publish, reproduce, or distribute through any interactive area on or via itworks.asia content that: does not infringe upon any Intellectual Property Rights; or has been expressly authorized by the lawful Intellectual Property Rights owner for Internet and Website distribution without restriction. Any content used with the permission of a copyright owner other than yourself must include a notice such as: “Copyright owned by [owner’s name]; used under authorization.” By submitting content to any interactive area, you automatically represent and/or warrant that either: you are the owner of such content; or the third-party owner of such content has granted itworks.asia a royalty-free, perpetual, irrevocable, non-exclusive, unrestricted worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, sublicense, distribute, perform, and display such content, in whole or in part, in any form and through any media or technology now existing or later developed. You also grant itworks.asia the right to sublicense such rights to third parties without restriction. Additionally, you authorize itworks.asia to use your company name and logo for marketing purposes.
Links, Disclaimer of Warranties, and Limitation of Liability

All such content, goods, and services accessible through linked websites are provided by independent third parties and are not part of or controlled by itworks.asia. itworks.asia does not endorse and shall not be responsible for the accuracy, completeness, usefulness, quality, or availability of any content, goods, or services provided on linked third-party websites. Such responsibility belongs solely to the independent third parties providing them, and your use of such sites is entirely at your own risk. Compliance and Handling of Violations
You must fully comply with the provisions set forth in the Order Form, Service Agreement, and these Terms & Conditions as a prerequisite for using the Services. In the event that you violate any provisions stated in the Order Form, Service Agreement, or these Terms & Conditions, we reserve the right to remove any job postings, content, or links associated with your account and terminate the provision of services without refunding any Service Fees or any unused portion of fees already paid. Additionally, we reserve the right to require compensation for any damages or losses arising from your violation.
Indemnification
You agree to indemnify and hold harmless the itworks.asia Website, its parent company, subsidiaries, affiliates, directors, employees, contractors, and agents from and against any liabilities, claims, losses, damages, and expenses, including reasonable attorney fees, arising from your violation of this Agreement, any related policies, your use of or access to the itworks.asia Website or any linked websites, or your transmission of any content through the itworks.asia Website.
Confidentiality
You agree to maintain the confidentiality of all information related to the Services, transactions, and/or any other information collected during the course of conducting transactions. You shall cooperate in preventing and combating any unauthorized copying or misuse by third parties of your job postings or other information on the Internet. You may not disclose, share, or sell any applicant information collected through the use of the Services to any third party in any form without the prior written consent of the Company.In addition, Customers are responsible for maintaining the confidentiality of their account credentials and passwords, and may only use their accounts for their own recruitment purposes in accordance with the agreements specified in the Order Form and/or Service Agreement.
Miscellaneous Provisions
This Agreement constitutes the entire agreement between the itworks.asia Website and you, and supersedes all prior agreements relating to the subject matter herein. The itworks.asia Website may amend this Agreement or any related policies at any time and from time to time, and such amendments shall become effective immediately upon posting the notice of amendment prominently on the itworks.asia Website. You agree to review this Agreement periodically in order to stay informed of any modifications. If you do not agree to such modifications, you must discontinue accessing the itworks.asia Website. Your continued access to and use of the itworks.asia Website following the posting of any such modifications shall constitute your acceptance of all such modifications. If any provision of this Agreement or any related policy is found to be invalid or unenforceable, such provision shall be interpreted in accordance with applicable law as closely as possible to reflect the original intentions of the parties, and the remaining provisions shall remain in full force and effect. The failure of the itworks.asia Website to enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. This Agreement shall be governed by and construed in accordance with the laws of the state or province in which the itworks.asia Website is based, without regard to conflict of law principles, and both you and the itworks.asia Website agree to submit to the exclusive jurisdiction of the courts located within such state or province. This Agreement is personal to you, and you may not assign your rights or obligations to any other party. All logos, affiliate names, product names, trade names, and service marks appearing herein may be the trademarks or service marks of their respective owners. References to any trade names, service marks, and links to or from the itworks.asia Website are provided strictly for identification and clarification purposes only and do not constitute endorsement by the itworks.asia Website of any products, services, or information offered by the respective owners, nor do they constitute endorsement of the itworks.asia Website by such owners.

itworks.asia collects personal information with the consent of users and only to the minimum extent necessary for providing services. All collected personal information shall only be used within the scope of the purposes previously notified to users.

In addition to collecting information for the purposes stated above, itworks.asia may cooperate with competent legal authorities and share your personal information for the following purposes:
- Complying with legal obligations; protecting against fraud, unauthorized transactions, and other liabilities; securing our website and applications; and enforcing our Terms & Conditions.
- In emergency situations where it is necessary to immediately process relevant personal data in order to protect the life or health of the data subject or another person. The Personal Data Controller, Personal Data Processor, Personal Data Controller and Processor, or Third Party shall be responsible for proving such circumstances.
- Processing by competent state authorities in cases of national defense or security emergencies, social order and safety emergencies, major disasters, dangerous epidemics, situations threatening national security or defense that have not yet reached the level of declaring a state of emergency, as well as for riot prevention, anti-terrorism, crime prevention, and handling violations in accordance with applicable laws.

Candidate and employer data shall be retained until a valid request for deletion is submitted and processed. Data is securely stored on servers operated by itworks.asia and located in Vietnam.
- How and With Whom Does itworks.asia Share Data?
How itworks.asia Shares Your Personal Information
- With your consent: Since the information we collect constitutes your personal data, itworks.asia will not disclose your personal information to any third party without your consent.
- When legally required to share personal information, including the following cases:
- To enforce the Terms of Use and Privacy Policy that you accepted upon registering an account and using the services of itworks.asia.
- To comply with requests from competent authorities, applicable laws, regulations, or government requirements.
- To protect the rights and interests of other users during their use of the website.

- Purpose of Disclosure: To support candidates in searching and applying for jobs.
- Data Shared: itworks.asia provides employer-related information on the Website, including company name, company activities, company website, images, and job postings.
Recipient: Employers
- Purpose of Disclosure: To support recruitment activities by providing candidate information and application documents to help employers evaluate and select suitable candidates.
- Data Shared: Candidate information including personal information, résumé/CV, job applications, and cover letters.
Recipient: Service Providers
- Purpose of Disclosure: To provide services related to website improvement, user protection, and optimization of services and user experience.
- We may also share your information with affiliated companies, vendors, or other service providers that perform functions on our behalf, including but not limited to: Analytics services (e.g., Google, Saramin, or their affiliates); Marketing and advertising services (e.g., Meta Platforms, Google, VNG Corporation, CocCoc, Propeller Ads, or their affiliates); Login/registration gateway services (e.g., Google, GitHub, Apple ID); AI tools and services (e.g., OpenAI or its affiliates); Email services (e.g., Google, SendGrid, Netpion, or their affiliates); Telecommunications services (e.g., Viettel, Mobifone, Vinaphone). These organizations and individuals may process personal data shared by us. In cases where service providers are located overseas, the processing of personal data may occur outside the territory of Vietnam. Whenever a third party processes data on our behalf, we will use commercially reasonable efforts to require such third parties to comply with this Privacy Policy or implement additional safeguards to protect your information.

- Methods and Tools for Users to Access and Edit Their Personal Data
For Candidates: Users may exercise the following rights at any time:
- Right of Access: You have the right to know about our information practices. You also have the right to access the categories of data we collect and to know with whom we share your data.
- Right to Rectification: You may edit certain personal data through your account settings. You may also request that we modify, update, or correct your data in certain circumstances by emailing info@itworks.asia.
- Right to Erasure: You have the right to request deletion of your Personal Data by sending a request from the email address associated with your account to info@itworks.asia and following the instructions provided in the “Profile Management” section.
Data Deletion Process and Method
- We will verify that your request is valid and includes all required steps and information.
- Your personal data will cease to be visible to third parties and will be permanently deleted within 72 hours of the request.Deleted personal data cannot be recovered. A separate list of users who requested deletion will be maintained to prevent restoration from backup servers.
- Certain information may still be retained by third parties if you had previously consented to sharing your personal data. Please note that while itworks.asia will notify employers of deletion requests, we cannot control the retention or use of your information by employers or third parties who have already accessed it.
- Right to Withdraw Consent: Where we rely on your consent to process your Personal Data, you have the right to withdraw such consent at any time. You may refer to the “Profile Management” page for instructions on withdrawing consent. In the case of withdrawing a job application, itworks.asia will notify the employer to whom you applied and request that the employer cease contacting you. However, your application information may still be retained for record-keeping purposes regarding transaction history between candidates and employers. You may also contact info@itworks.asia to notify us that you are withdrawing your consent. Please note that any processing activities conducted before the withdrawal of consent remain lawful. Withdrawal of consent does not affect the legality of data processing based on consent prior to its withdrawal (Clause 1, Article 12 of Decree 13 on Personal Data Protection).
- Right to Object / Opt-Out: If you wish to stop receiving a specific marketing email, you may click “Click here to unsubscribe from emails from itworks.asia” located at the bottom of each marketing email. You may also opt out of all marketing communications by emailing info@itworks.asia. We will comply with your request as soon as reasonably practicable and in accordance with applicable laws.
For Employers: Employers may exercise the following rights at any time:
- Right to Access Candidate Information: Employers may access candidate information when a user applies for a job posted by the employer.
- Right to File Complaints Regarding Disclosure of Personal Information. Employers may submit complaints to the administration team of itworks.asia. Upon receiving such complaints, itworks.asia will verify the information, provide explanations, and guide users in restoring and securing their information.
- Handling Requests for Withdrawal of Applications, CV Deletion, or Account Deletion by Candidates. To ensure compliance with personal data protection laws, employers are requested to follow the procedures below:
